What Is a Prescription Drug?

Arizona law prohibits the possession, use, administration, acquisition, sale, manufacture or transportation of prescription-only drugs without a valid prescription from a licensed provider.  “Prescription-only” drugs are part of the larger classification of controlled substances, and include any drug that:

  • Is deemed safe for use only by or under the supervision of a medical practitioner;
  • Is new and is limited in its application under federal or state law to use by a medical practitioner;
  • Is potentially harmful, and does not contain appropriate directions for use by the consumer; and/or
  • Is required under federal law to bear the legend “Caution:  Federal law prohibits dispensing without prescription” or “Rx only.”

A violation of this section of the drug law may be a Class 1 misdemeanor or a Class 6 felony, with penalties including probation, possible jail time, fines, 240 hours of community service, and drug testing.  Illegal possession of prescription drugs which are narcotics or other dangerous substances are Class 4 felonies, which carry a presumptive sentence of 2.5 years in prison.
