Bombs Found on ASU Campus

A recent report claims that bombs have been found at the Tempe campus of Arizona State University. The bombs were allegedly discovered in one of the school’s residence halls. According to the police, the discovery came after the publication of a social media post showing an individual holding two “explosive devices.” Other reports state that a student notified police that the bombs were present.

Another student at the school has been arrested as a result of the discovery of the devices. The student says that he had no intention of doing anything with the bombs, and simply made them for “entertainment purposes,” presumably to show other students. In any event, since there is no evidence at this point that the student intended to do any harm, the question becomes what crime was committed.

In Arizona, A.R.S. 13-3102 defines the crime of “misconduct involving weapons.” The law contains a host of different acts, most of them felonies, which fall under the general heading of the statute They include, for example:

  • Carrying a concealed weapon in or on a means of transportation.
  • Possession of a deadly weapon by a prohibited possessor.
  • Weapons trafficking.
  • Possession of a deadly weapon in furtherance of an act of terrorism.
  • Providing a deadly weapon to a person you believe will use the weapon to commit a felony.

These are just a few examples of the types of acts that fall within the definition of misconduct involving weapons. There are also sections that apply to possession of weapons in a school or on school grounds, although there is some question as to whether ASU is a “school” and whether the college dorm is “school grounds” within the meaning of the statute.

The answer to the question of what charge might apply is actually rather simple. Manufacturing or possessing a “prohibited weapon” – including bombs – is a class 4 felony. You need not intend to do any additional illegal act with the weapon. Possession itself is the offense.
