Prescription drug crimes have serious consequences
Facing a Prescription Drug Charge?
Have you been charged with the illegal use or possession of prescription drug? Additional charges may include fraud and/or forgery in connection with obtaining the drugs, distribution, DUI or even a violent crime. If so, you may be one of many people who have been caught up in the growing problem involving the misuse of pharmaceuticals. In fact, both the White House Office of National Drug Control Policy, and the Centers for Disease Control and Prevention, have stated that prescription drug abuse is an epidemic, and is the nation’s fastest-growing drug problem. And the first step in understanding the criminal laws in this area is to define what is meant by a “prescription drug.”
What Is a Prescription Drug?
Arizona law prohibits the possession, use, administration, acquisition, sale, manufacture or transportation of prescription-only drugs without a valid prescription from a licensed provider. “Prescription-only” drugs are part of the larger classification of controlled substances, and include any drug that:
- Is deemed safe for use only by or under the supervision of a medical practitioner;
- Is new and is limited in its application under federal or state law to use by a medical practitioner;
- Is potentially harmful, and does not contain appropriate directions for use by the consumer; and/or
- Is required under federal law to bear the legend “Caution: Federal law prohibits dispensing without prescription” or “Rx only.”
A violation of this section of the drug law may be a Class 1 misdemeanor or a Class 6 felony, with penalties including probation, possible jail time, fines, 240 hours of community service, and drug testing. Illegal possession of prescription drugs which are narcotics or other dangerous substances are Class 4 felonies, which carry a presumptive sentence of 2.5 years in prison.
Given the substantial penalties that may apply, it is important, if you have been arrested, to hire an experienced attorney for your defense.
